Linda suffered a significant shoulder fracture that required immediate internal fixation. Internal fixation is an operation in orthopaedics that involves the surgical implementation of implants for the purpose of repairing a bone.
While the surgery seemed successful at first, complications soon arose. A post-operative infection developed, leading to a series of additional surgeries, including the removal of the metalwork and a partial shoulder replacement known as a hemiarthroplasty.
Despite these interventions, Linda continued to experience issues with infection. Her left rotator cuff failed entirely, leaving her with severely limited movement in her shoulder joint. Multiple attempts to reconstruct the shoulder were unsuccessful and Linda was left with significant ongoing pain.

The report criticised the standard of care Linda received, particularly the failure to administer sufficient intraoperative antibiotics and the decision to perform both the removal of the metalwork and the hemiarthroplasty in a single procedure without first isolating the source of her ongoing infection.
Expert reports were also obtained to evaluate Linda’s ongoing needs and future prognosis. Her injury had a profound impact on her daily activities, particularly as she aged.
The case was settled shortly before trial without an admission of liability from the Defendant. They had strong expert opinions refuting the allegations made on Linda’s behalf. Given the liability risk had the matter proceeded to trial, Linda was content to compromise her claim following extensive negotiations.
Ultimately, Linda recovered approximately 60% of the value of her claim, amounting to a six-figure settlement. This settlement will go some way in covering her ongoing medical expenses and improving her quality of life.
