Young girl’s surgical negligence claim settled for €120,000

A settlement has been approved in the High Court for a young girl who underwent multiple surgeries to correct a squint, leaving her with a significant cosmetic issue.
The girl, who was born with a congenital squint in her left eye, underwent six eye surgeries between the ages of two and seven at University Hospital Waterford. As part of these procedures, surgery was also performed on her right eye, which had not been affected.
While her vision was not impaired, the surgeries resulted in an overcorrection that left the girl with a noticeable cosmetic issue, causing her left eye to turn upwards.
The family contacted Augustus Cullen Law’s clinical negligence department
The girl’s family approached Augustus Cullen Law seeking assistance in understanding what had happened and to secure the necessary supports for her future needs.
They instructed Jamie Hart, who obtained expert medical reports indicating that negligence had occurred. Medical opinion suggested that if intervention had ceased in 2012, the girl would likely have a normal appearance today.
Jamie instructed Counsel and court proceedings were issued against the hospital.
The hospital denied liability.
A settlement was reached
While liability was not admitted, the matter was settled for €120,000, a settlement which amounted to the full value of the case having regard to the Personal Injury Guidelines.
Acknowledging the court’s comments
At the approval hearing, Mr Justice Paul Coffey described the settlement as “fair and reasonable”. He extended his best wishes to the girl for the future. He went on to acknowledge the challenges the family had faced in seeking answers about her care and recognised the impact the case had on their lives.
