Micheál injured his ankle to a degree which he required surgery to repair it. He underwent surgery that initially appeared to go well; however, he suffered a post-operative infection.
The infection itself was not negligent but the surgeon did not take adequate steps to resolve it.
Instead, Micheál was discharged on oral antibiotics which failed to resolve the issue. Ultimately, he required a lengthy inpatient stay with IV antibiotics and a further two surgeries to remove metalwork from his ankle which had become infected.
Micheál’s recovery was extended by roughly a year.
Micheál contacted us and had the benefit of an initial consultation with Eoin Collins from our clinical negligence department. Micheál, impressed by our track record of previous successes, instructed us with his claim.
Eoin engaged experts in orthopaedics to produce medical reports on the care received by the client. He also instructed an expert in infectious diseases to produce a report on the extent of the damage caused by the negligence in the case.
Liability was not admitted, and the matter was further complicated by the sad passing of one of the Defendant medical professionals involved.
Despite this, the hospital did show a willingness to negotiate and we recovered the full value of Micheál’s claim by way of settlement in the amount of €235,000.
