Liam suffered with recurrent respiratory symptoms from shortly after birth. He attended his GP regularly with respiratory symptoms and was diagnosed with asthma. This continued for many years with the client suffering recurrent chest infections and missing school.
Eventually, at the age of 16, after attending a new GP who recognised the client’s symptoms were not simply recurrent chest infections and made an immediate referral, client was diagnosed with Cystic Fibrosis.
Unfortunately, the client experienced approximately 7 years of pain and suffering as a result of the delay in diagnosis.
Liam and his parents contacted our medical negligence team with a view to get justice.
Mary Ní Ghuairim was instructed with the case and obtained a report from an Expert GP who was of the opinion that a diagnosis should have occurred many years ago when Liam had been suffering recurrent chest infections and was underweight.
We also instructed an Expert Respiratory Physician to comment on the effect of the 7 year delay. The expert noted that but for the delay in diagnosis the client would have been spared years of pain and suffering for the child.
Liability was not admitted and a trial date was fixed, however the case ultimately settled 2.5 weeks prior to the trial date.
The matter settled for €135,000 plus Liam’s legal costs.
