Baby Eoghan was admitted to Portiuncula Hospital with a fever. He had been referred by a GP who noted he was quite unwell, with a fever, breathlessness and lethargy.
He should have been administered antibiotics upon his admission to the hospital but was not.
Over the course of 12 hours, his condition deteriorated significantly. Eoghan developed sepsis, experienced a cardiac arrest and suffered multi-organ failure, leading to severe brain damage. He now requires round-the-clock care for the rest of his life.
An internal hospital review was conducted into Eoghan’s injuries, but his parents were unaware of its existence for many months, when it was unexpectedly delivered to their home by registered post — five months after its completion.
The understandably concerned and upset parents contacted Augustus Cullen Law with a view to pursue the vital compensation required to meet Eoghan’s complex medical needs.

Eoghan’s case settled following mediation with the hospital.
The hospital apologised for the failures of care in the child’s treatment and for the manner in which its internal review was undertaken and communicated to the family.
Eoghan and his family will receive several seven-figure interim payments over the course of his childhood which will cover the cost of his complex current and future needs.

The judge remarked on the “fantastic” work by the child’s mother, a trained teacher prior to becoming the full time carer of her son, in helping Eoghan develop a switch facility which will assist his future development.
Counsel, who was instructed by Jamie Hart, explained that the family home has been extensively adapted to accommodate Eoghan’s needs, including the installation of a hydrotherapy pool. He added that Eoghan is as active as possible, receives a variety of care and support services and attends a special education school that he thoroughly enjoys.
