Medical Negligence
What is laparoscopic (keyhole) surgery and can I claim if it goes wrong?
3 minute read
Laparoscopic surgery, more commonly known as keyhole surgery, is a technique that uses small incisions and a tiny camera to allow surgeons to carry out procedures inside the body.
While it usually means faster recovery and fewer complications than traditional open surgery, things can still go wrong. When errors happen, the consequences can be serious and may give rise to a surgical negligence claim.
What medical conditions are keyhole surgery used to treat?
Keyhole surgery is now a common approach in hospitals across Ireland because it allows doctors to treat a wide range of conditions with less disruption to the body.
Examples include:
- Removing the gallbladder to treat gallstones
- Repairing a hernia
- Taking out the appendix in cases of appendicitis
- Treating endometriosis or removing ovarian cysts
- Performing weight loss surgery such as gastric band or bypass procedures
- Operating on the bowel to manage Crohn’s disease or diverticulitis
These are just some examples. Laparoscopic techniques are used to treat a growing number of conditions.
What can go wrong with keyhole surgery?
Although laparoscopic surgery is generally safe, mistakes can and do happen. Because the surgeon is working through small incisions and relying on a camera for visibility, there is always a risk of complications if proper care is not taken.
Examples include:
- Damage to internal organs
- Internal bleeding
- Infections
- Anaesthetic errors
- Foreign objects left inside the body
- Conversion to open surgery due to complications that should have been avoided
Some complications may be an accepted risk of surgery, but others arise because of avoidable errors.
When negligence is involved, patients may be entitled to bring a surgical negligence claim.
Signs that negligence may have occurred
Not every complication following keyhole surgery will amount to negligence, but there are warning signs. If your recovery is unexpectedly prolonged, if you suffer new or worsening symptoms that were not explained as part of the normal risks, or if further corrective surgery is required, it may indicate that an error was made during your procedure.
In such cases, you should consult your doctor about your condition and seek legal advice on whether you may have grounds for a claim.
How do I make a keyhole surgery claim in Ireland?
If you believe you have suffered avoidable harm because of negligent keyhole surgery, the first step is to obtain specialist legal advice.
A solicitor experienced in medical negligence will review your case, gather your medical records and arrange for independent medical experts to assess whether the standard of care you received fell below what could reasonably be expected.
Strict time limits apply, so it is important to act promptly.
